These Terms of Service are a legally binding contract between you and SANDSTORM regarding the use of our website constituted under Colombian law, whose main activity is to allow the display and commercialization of products for online purchase.

ACEPTANCE OF TERMS AND CONDITIONS

ORDERS:
The stock availability of each of our products will be indicated by the possibility of selecting the quantity, reference, and size, and its inclusion in the shopping cart. However, if the product is no longer available between the purchase and the order processing, you will be informed immediately, and you can cancel the purchase.
Purchases can be done at any time and day of the week. However, if the order is made after 6:00 pm (Colombian Time) or on Saturdays, Sundays and holidays, it will be processed the next business day.
COLORS:
We try to display the colors of our products as accurately as possible. However, these may vary depending on the device and screen from which you browse. For this reason we cannot guarantee that the display you have from your device is identical to the real color.
PRICES:
The prices shown on our site www.sandstormsw.com depend on the country you are located in. They will be shown in Colombian pesos (COP $) for clients in Colombia, and US dollars (USD $) for other countries. These prices include taxes. In no case are the prices in USD calculated based on the exchange rate of the COP, these are differentiated for products sold outside of Colombia. If you are a customer whose credit/debit card is denominated in currency different to COP or USD, the final price will be calculated according to the applicable exchange rate on the day the transaction is processed by the card issuer.
SANDSTORM reserves the right to determine the price of products and to make changes to them without prior notice, but the price applicable to your order will be the price that is published at the time you make the transaction and your order and payment is accepted.
SANDSTORM will make reasonable efforts to keep the pricing information posted on the website up to date. We recommend that you visit our website periodically for current pricing information. The shipping cost is not included in the value of the products. This will be informed during the purchase process at check-out, after entering the delivery address for your order.
CURRENT PROMOTIONS
SANDSTORM can make promotional offers with different characteristics, dynamics, and prices without these being applicable to all buyers. In the publication of such offers, the conditions of time, mode, and place to be able to access them will be mentioned.
PAYMENT METHODS
For the processing of payments through the website, SANDSTORM allows clients to use payment platform services for online transactions owned by third parties, which correspond to WOMPI and ADDI for Colombia, and STRIPE for international purchases. When clients include personal data for payment processing such as credit card number, among others, the use and protection thereof are governed by the terms and conditions of WOMPI, ADDI, and STRIPE. SANDSTORM will not be responsible for the operation, performance, availability and/or security granted by WOMPI and STRIPE. When proceeding with the payment of a purchase through WOMPI, ADDI, and STRIPE, the User will leave the SANDSTORM platform for a moment, to later re-enter it once the status of the payment is known (rejected or approved). Throughout this period, the WOMPI, ADDI, and STRIPE conditions applicable to the payment transaction will govern.
The payment methods provided by SANDSTORM through payment platforms are:
- Wompi: QR code, Nequi, bank transfer through PSE, and credit card payments through the franchises: Visa, MasterCard and American Express.
- Stripe: Credit card payments through the franchises: Visa, MasterCard and American Express.
SOURCE OF FUNDS
When making a payment through www.sandstormsw.com and being processed and approved by the WOMPI or STRIPE payment gateway for purchases in Colombia and internationally, the client declares and maintains that:
a. The resources with which the purchase was made come from legal operation, trade, profession, activity or business, and under no circumstance from illicit, clandestine or law-breaking situations or activities.
b. The money with which the purchase was made was NOT obtained by virtue of any type of conduct that is considered as illicit or a criminal offense by Colombian and International law.
c. You have never allowed third parties to use your accounts or credit or debit cards to transfer or manage money that you do not know its origin, or that comes from conduct contrary to the law and especially to criminal law.
d. SANDSTORM is exempt from all liability for erroneous, false, inaccurate information that may have been provided.
Habeas data
In accordance with Colombian Law No. 1581 of 2012, Decree No. 1377 of 2013, and other complementary regulations, SANDSTORM declares itself as responsible for the processing of personal data, in accordance with the definitions of Law, and therefore collects, stores, and processes the personal data of the Users of the platform in the development of its commercial activities and sale of its products in online channels, or in promotional events, among others.
Platform Users may access the Privacy and Personal Data Processing Policy available at www.sandstormsw.com to learn about the purposes, rights and duties related to the processing of their personal data by SANDSTORM.
MODIFICATION AND UPDATE OF TERMS AND CONDITIONS
SANDSTORM, at its own discretion or due to technical needs, may modify, update, add and/or eliminate functionalities, services and contents from the platform, as well as these Terms and Conditions, at any time and without the need for any notification to Users, as long as they do not affect the normal operation or the purposes of the platform. If the modifications constitute significant changes, SANDSTORM will promptly notify Users through emails, written communications or by posting directly on the platform.
